Duty of Family Members of EU Citizens to Apply for a Replacement of a Residence Permit Card

Family members of EU citizens who are third country nationals have an obligation to apply for a replacement of their residence permit card, which is in the form of a paper booklet, for a biometric card.

Validity of resident permit cards which are in the form of a paper booklet expires on 3rd August 2023. By then, one must apply for a replacement for a biometric card, which is free of charge.

The replacement of the card does not apply to:

  • family members of EU citizens, who already have a biometric card (plastic card), or
  • citizens of an EU member state, Switzerland, Liechtenstein, Norway, Iceland or the United Kingdom of Great Britain and Northern Ireland, who fall under the second Part of the Withdrawal Agreement.

It is only possible to replace residence permit cards which are still valid. It will not be possible to replace them beyond the stated deadline.

If you do not file your application for a residence card replacement, you will have to ask for its extension and cover the administrative fee CZK 200.

Replacement of your card does not extend the period of its validity.
Extension of its validity requires the filing of an application. You can apply for your card validity extension within one single application. It is sufficient to indicate by marking, that you wish for both actions to be done.

Who does the obligation to replace the card apply to?

You have to replace your card if you:

  • are a family member of an EU citizen,
  • are a third country national,
  • are holding a card in the form of a paper booklet.

How to apply for a residence permit card replacement for a biometric card?

You can file the application for a card replacement by 3rd August 2023, at the latest.

You can file the application at a counter of the Ministry of the Interior, send it through a registered letter, via a Data Box, per an e-mail with an advanced electronic signature or by a proxy.

After that, it will be necessary to undergo biometric data sampling, for the issue of a new residence permit card.

What to do if the validity of my card is about to expire (e.g. in the next 6 months)?

Replacement of your card does not change/extend the period of its validity.

If the validity period of your current card is about to expire soon (e.g. in 6 months or sooner), we recommend applying for an extension of your card validity at the same time as you apply for your card replacement, using one single form for both actions.

The administrative fee for application for validity extension is CZK 200, payable by duty stamps.

What to do if the validity of my card has expired?

If you have a temporary residence permit of a family member of an EU citizen, you will have to apply for its extension. The administrative fee for an application for its extension is CZK 200, payable by duty stamps.

If you have a permanent residence permit of a family member of an EU citizen, you will have to apply for an issue of a new permanent residence permit card, or for an extension of a permanent residence card.
