Residence of a Child Born in the Czech Republic - EU Citizen or Their Family Member

If your child who is an EU citizen is born in the Czech Republic, you do not have to apply for a residence permit for him/her. If you wish, however, as the child’s legal representative you can apply for:
If the newly born child is going to reside in the Czech Republic for over 3 months, you can apply for a registration certificate for him/her. In this case, you need to pay medical insurance for the child. A registration certificate may be required for the child’s enrolment in a kindergarten or an elementary school, some leisure activities and voluntary clubs.
If you reside in the Czech Republic with a permanent residence permit, you can apply for a permanent residence permit for the child (who is an EU citizen) on humanitarian grounds. As purpose, please state family reunification with a legal representative who holds a permanent residence permit. If you apply within 60 days from the date the child was born, he/she will be covered by the public medical insurance from the date of his/her birth until the final decision comes into effect. If the application is granted, the child will naturally continue to be covered.
Who can apply?
Only the child’s legal representative can apply (e.g. a parent). In the case of a permanent residence permit application, the application can only be submitted in person.
Where can you submit the application?
You can submit the application at a Ministry of the Interior office according to your reported place of residence (address) in the Czech Republic.
What if you do not submit the application in time?
If you could not submit the application for reasons beyond your control, the 60-day time limit is considered extended until these reasons cease to exist. You must inform the Ministry about such reasons.
If you do not manage to submit the application within the 60-day time limit and you cannot prove the existence of reasons beyond your control, you can still apply for a permanent residence permit of an EU citizen on humanitarian grounds. In such case, please follow the same steps as for a permanent residence permit of an EU citizen application. This way you pay the child’s medical insurance from the date s/he was born till the date you collect the permanent residence permit for him/her. Subsequently, the child starts to be covered by the public medical insurance. Besides this, you can apply for a registration certificate for the child.
How is it with the child’s medical insurance?
If the child is an EU citizen, you always have to pay medical insurance for him/her from the date he/she was born. You are exempt from this obligation if you apply for a permanent residence permit for a child born in the Czech Republic within 60 days from the date he/she was born (but you need to hold a permanent residence permit yourself). In this case, the child is insured from the moment he/she is born.
If your child born in the Czech Republic becomes a Czech citizen (e.g. if one of the parents is a Czech citizen), this procedure does not apply to him/her.
You can also apply for both types of residence permits for a child who was not born in the Czech Republic. However, you must pay medical insurance for him/her and follow the standard procedure for a permanent residence or registration certificate application.
If your child who is an EU citizen’s family member is born in the Czech Republic, he/she is permitted to reside temporarily in the Czech Republic as long as his/her legal representative resides in the country, but at the longestfor 60 days from the date he/she was born. If the child was to reside in the country longer, you have to apply for:
If the child is going to reside in the Czech Republic with an EU citizen for over 60 days, as his/her legal representative you must apply for a temporary residence permit of an EU citizen’s family member for him/her. You can submit this application at the latest 3 months from the date on which the 60-day time limit from the child’s birth expired.
If you reside in the Czech Republic with a permanent residence permit, as the child’s legal representative you can apply for a permanent residence permit for him/her (on humanitarian grounds, for the purpose of family reunification). You must do so within 60 days from the date he/she was born. If you apply within the given time limit, the child’s residence is considered permanent from the date he/she was born to the moment the final decision on the application comes into effect (upon the collection of the document). This means that during that time the child will be covered by the public medical insurance. If the application is granted, the child will naturally continue to be covered. If you do not want to apply for a permanent residence for the child, you can apply for a temporary residence permit of an EU citizen’s family member for him/her for the purpose of family reunification with his/her legal representative (who is an EU citizen).
