Who can apply for a long-term visa for the purpose of leave to remain in the Czech Republic?

  1. A foreigner who cannot leave the country for reasons out of his/her control or if conditions under Section 179(5) of the Foreigners Act (Section 33(1a) of Act No. 326/1999 Coll.) are met;
  2. a foreigner who is a witness or an injured party in criminal proceedings and his/her participation in the proceedings is necessary (Section 33(1b) of Act No. 326/1999 Coll.);
  3. a foreigner who has applied in the Czech Republic for a permanent residence permit under Title IV of the Foreigners Act, if entitled to do so, in the time when his/her residence permit was still valid and the validity of which cannot be extended, provided that no decision on the application had been taken during the time his/her residence permit was still valid (Section 33(1c) of Act No. 326/1999 Coll.);
  4. a foreigner who has brought a legal action against the Ministry’s decision to revoke a visa for a stay longer than 90 days, a long-term residence permit or a permanent residence permit, or to reject an application for extension of a long-term residence permit, under the condition that at the same time he/she has filed for a suspensive effect of such legal action (Section 33(1d) of Act No. 326/1999 Coll.);
  5. a foreigner who, as a minor child of a foreigner who has resided in the country with a permanent residence permit, has brought a legal action against the Ministry’s decision to reject his/her application for a permanent residence permit submitted in the Czech Republic under Section 66(1d) of Act No. 326/1999 Coll. (permanent residence permit for the purpose of family unification (child of a foreign national with a permanent residence permit)), under the condition that at the same time he/she has filed for a suspensive effect of such legal action (Section 33(e) of Act No. 326/1999 Coll.).

How long is this visa valid for?

For the period of time strictly necessary, but for the maximum of 1 year.

What obligations and restrictions does this residence permit mean?

The validity of a visa for a stay longer than 90 days for the purpose of leave to remain expires when the holder leaves the Schengen Area.

If you hold a visa for a stay longer than 90 days for the purpose of leave to remain under Section 33(1a) of Act No. 326/1999 Coll., upon the Ministry’s request, you must prove that the reason preventing you from leaving the country still exists. If you cannot prove that for reasons out of your control, you can provide a declaration signed by you instead.

You must also follow the obligations for foreigners stipulated by law.
